9th U.S. Circuit Court of Appeals Recalls Mandate in Same-Sex Marriage Case

(Boise) – The 9th U.S. Circuit Court of Appeals has recalled the mandate it issued late Tuesday in the lawsuit challenging Idaho’s marriage laws.

The 9th U.S. Circuit Court of Appeals acted in response to a stay order entered earlier today by U.S. Supreme Court Justice Anthony Kennedy.

With recall of the mandate, Idaho is now back under 9th U.S. Circuit Court of Appeals rules and a stay remains in effect for the case until further notice from the appeals court or the U.S. Supreme Court.
