96 Idaho Libraries Will Receive Over 25,000 CDs From CD Settlement

(Boise) - Idaho public libraries will soon receive more than 25,000 music compact discs (CDs), Attorney General Lawrence Wasden said today. The distribution is a result of a legal settlement with five of the largest U.S. music distributors of CDs and three large CD retailers. The CDs will be shipped directly to libraries throughout Idaho beginning today.

The settlement stems from an August 2000 antitrust lawsuit which Idaho and 39 other states alleged in federal court that the defendant music distributors and retailers illegally entered into conspiracies to raise the price of CDs.

The court approved, as part of the settlement, the distribution of music CDs to not-for-profit corporations, charitable groups, and government entities. The CD distribution is the third aspect of the settlement. Other components included a mandatory change in sales practices of the defendants and compensation for consumers who purchased CDs with illegally inflated prices. 15,500 Idaho consumers who filed claims received approximately $214,830 in compensation.

"The defendants in the case hurt both the consumers and competitors through their unlawful activity," said Attorney General Lawrence Wasden. "The distribution of CDs is one way that the defendants can compensate for the harm inflicted on local communities."

The CDs will be representative of all genres of music and include such titles as: "The Very Best of Aretha Franklin" by Aretha Franklin; "Born to Fly" by Sara Evans; Louis Armstrong's "I Love Jazz;" Chopin "Nocturnes;," and "The Four Seasons" by Vivaldi.

The defendants in the lawsuit were music distributors Bertelsmann Music Group, Inc., EMI Music Distribution, Warner-Elektra-Atlantic Corporation, Sony Music Entertainment, Inc., Universal Music Group and national retail chains Transworld Entertainment Corporation, Tower Records, and Musicland Stores Corporation.
