Earnest Wayne Mercer Found Guilty of Influencing a Witness
(Boise) - An Ada County jury found Earnest Wayne Mercer guilty of influencing a witness in a criminal proceeding, Attorney General Lawrence Wasden said. After a two-day trial, the jury deliberated more than three hours before handing down the guilty verdict.
Mercer, 42, of Boise, was charged on August 16, 2002. Mercer contacted a witness in another criminal proceeding against him and told the witness to falsely state that she did not recall the details of a physical altercation between Mercer and his victim.
Mercer was acquitted on another charge of conspiracy to intimidate a witness in a criminal proceeding.
The Special Prosecutions Unit of the Attorney General's Criminal Law Division prosecuted the case at the request of Ada County Prosecuting Attorney Greg Bower. Deputy Attorney General Ken Robbins prosecuted the case.
Fourth District Judge Thomas Neville set the sentencing hearing for September 22, 2003.
